AUSTIN, Texas — On Monday, May 22, 2023, at around 9:05 p.m., the Austin Police Department (APD) responded to a shooting incident at a Dairy Queen located in the 9300 block of S IH 35 SB. The victim, identified as Efrain Jaimes, a 19-year-old Hispanic male, sustained a gunshot wound during the altercation and was later pronounced dead at a local hospital.

According to initial reports, the caller, who stated he was the father of Jaimes' child, reported shooting Jaimes in self-defense after being attacked. Upon arriving at the scene, officers found the caller who cooperated with the investigation. While no gunshot victim was found at the scene, a subsequent 911 call informed authorities that Jaimes had been transported to a nearby hospital for treatment.

Investigating officers determined that Jaimes had initiated the attack against the man, who was known to him. In response to the assault, the man defended himself by discharging his firearm, resulting in Jaimes' gunshot wound. The case has been handed over to the Travis County District Attorney's office, which has decided not to file charges at this time.
